At Mingle we’re committed to providing you with the best experience possible, helping you connect with others in a fun, safe, and seamless way. We’re always working to improve Mingle, ensuring that every interaction is smooth, enjoyable, and secure.

By downloading, installing, or using our app, you agree to these Terms of Service & End User License Agreement (EULA), which outline your rights, responsibilities, and the guidelines that keep our community safe and enjoyable. Please read them carefully. If you do not agree with these terms, we kindly ask that you do not use the app.

1. Acceptance of Terms & End User License Agreement (EULA)

By accessing, installing, or using Mingle, you enter into a legally binding agreement to comply with these Terms of Service & EULA and our Privacy Policy. This agreement governs your license to use the application. If you do not agree, you must cease using and delete the app immediately.

2. End User License & Apple Specific Mandates

Mingle grants you a personal, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes on Apple-branded products, subject to the Apple Media Services Terms and Conditions.

Acknowledgement: You acknowledge that this agreement is concluded between you and Momentous Studio only, and not with Apple Inc. Momentous Studio, not Apple, is solely responsible for the Mingle application and the content thereof.
Maintenance & Support: Momentous Studio is solely responsible for providing any maintenance and support services for Mingle. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services.
Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

3. Description of Service & Core Features

Mingle provides platform features designed to connect users spontaneously and authentically without endless swiping. All core interaction features on Mingle utilize Magnets, our virtual in-app currency.

Pre-Connection Transparency: Mingle is not an anonymous or blind matching app. Before any interaction or video feed begins, users are shown identifiable profile details (including display name, main photo, age, bio parameters, videos, voice notes, custom captions, extended profile attributes, vibe tags, and balance sliders) and must explicitly choose to accept, decline, or skip the connection.
Matching Preferences: Mingle respects your specified profile preferences, including gender identity options (Men, Women, Non-Binary, or Everyone), geographical country filters, and the option to hide your profile from your phone contacts if you grant us access.
Live Mingle: Connects users for short, spontaneous video calls using Magnets. Each session lasts approximately 60 seconds and automatically disconnects. Built-in safety features require users to keep their faces visible on camera. If a face is not detected, the video feed automatically blurs. Profiles are only revealed if both users mutually opt to match during or at the end of the session.
Spin the Bottle: A text-chat connection feature where users spend Magnets to spin a virtual bottle and connect with another user based on preferences. The moment the bottle lands and connects you to a user, their profile is instantly revealed.
Magnet Consumption Policy: For all features across Mingle, Magnets are only consumed upon a successful connection with another user. If the system fails to connect you to someone, no Magnets are spent.

4. Chat Mechanics, Limits, & Sending a Drink

To ensure premium communication quality and zero spam, text and voice conversations initiated via Spin the Bottle are subject to strict interaction rules:

Anti-Spam Gatekeeping: When a bottle lands on a user, a text or voice conversation cannot begin until the receiving user explicitly chooses to reply. If the receiving user does not reply, the initiating user cannot send any further messages or content, keeping your inbox entirely in your control.
Turn-Based Limits & Voice Notes: Once a chat begins, both users are given a starting balance of 5 messages. Users must take turns communicating (you must receive a reply before sending another message) to prevent conversational flooding. Users may also send voice notes directly within matches to express themselves further.
Sending a Drink: Users may choose to spend Magnets to "Send a Drink" during a Spin the Bottle connection. Sending a Drink unlocks an additional 5 messages and completely removes the turn-based waiting restriction, letting you text and voice-chat freely for those 5 messages. Users can perform this skip-the-line unlock up to two (2) times consecutively before standard turn restrictions apply again.
Lifting Limits & Expiration: If the conversation is mutually reciprocated, it becomes an official match, and all chat limits and turn restrictions are lifted permanently. If a conversation does not progress or receive a response, the chat expires after 48 hours. Users may utilize the Reconnect feature to re-engage with past spins for a strictly limited window.

5. Account & Eligibility

You must be at least 18 years old to use Mingle.
You are responsible for maintaining the confidentiality of your account information and any other information or media you share on the platform.
Any violation of these terms may result in immediate suspension or permanent termination of your account.

6. Strict Zero-Tolerance Policy & Moderation SLA

Mingle maintains a STRICT ZERO-TOLERANCE POLICY for objectionable content, abusive behavior, and harassment.

Prohibited Conduct: Users strictly agree not to post, transmit, or share any nude, sexually explicit, violent, threatening, harassing, abusive, defamatory, or hateful content through text, profile videos, voice notes, captions, or images. Fraudulent activities, spam, and unsolicited advertisements are strictly prohibited.
Automated & On-Device Filtering: Mingle deploys automated text, audio, and vision-based content filtering frameworks to detect, blur, or block objectionable media, inappropriate voice content, and profanity in real time.
User Blocking Mechanism: Users have the right and ability to block any user at any time during a chat, video session, or from a user profile. Blocking immediately terminates the connection, suppresses all mutual communications, and prevents future matching.
User Reporting & 24-Hour Removal SLA: Users can flag objectionable content or abusive users directly within the app using the "Report" button on chat screens and profile cards. Momentous Studio pledges to review all reports and **act upon objectionable content and abusive users within 24 hours** by removing the offending content and ejecting/banning the responsible user.

7. Use of Magnets & In-App Purchases

Mingle operates entirely without recurring subscription fees using an ecosystem powered exclusively by our in-app currency, Magnets.

New accounts are credited with 50 free Magnets upon initial sign-up. Free Magnets can also be earned by inviting friends to join the app. If a referral invitation remains unclaimed, it expires after 30 days. Earned or promotional Magnets never expire.
Additional Magnets can be purchased directly through Apple's In-App Purchase architecture. These purchased Magnets are used to fund all premium features and choices inside the app, including spinning the bottle and sending drinks.
All virtual items and balances, including Magnets, are non-refundable by Mingle, hold no real-world monetary value, and cannot be transferred or exchanged. Misuse or fraudulent currency generation will result in immediate termination of the account.

8. Account Suspension & Termination

We reserve the right to suspend, restrict, or terminate user accounts at our sole discretion, without prior notice or liability, if a breach of these Terms of Service & EULA is found. Terminated or suspended accounts forfeit all unused or earned virtual Magnet balances without eligibility for compensation or reimbursement.

9. Limitation of Liability

Mingle is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. Momentous Studio is not liable for any direct, indirect, incidental, or consequential damages, emotional distress, losses, or real-world disputes arising from user interactions, connections, or conduct on the platform.

10. Changes to Terms

We may update these Terms of Service & EULA at any time. Continued use of the app after changes indicates your acceptance of the new terms.
